Terms of Service for Buoy Discord Bot

1. Acceptance of Terms

By adding Buoy ("the Bot") to your Discord server ("the Server") or using its services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Bot.

2. Description of Service

Buoy is a Discord bot that provides giveaway management services, including:

• Creating and managing giveaways
• Automatic winner selection
• Role-based participant eligibility checking
• Customizable giveaway embeds

3. User Responsibilities

3.1 Server Administration

You must have the necessary permissions ("Manage Events" permission) to use giveaway commands in your Server. You are responsible for all activities that occur under your Server's use of the Bot.

3.2 Compliance with Discord Terms

You agree to comply with Discord's Terms of Service and Community Guidelines. Buoy is not responsible for violations of Discord's policies that occur through use of the Bot.

3.3 Giveaway Management

You are solely responsible for:

• The legality of giveaways conducted using the Bot
• Compliance with any applicable laws regarding giveaways and contests
• Proper prize distribution to winners
• Ensuring giveaway rules are clear and fair to participants

4. Prohibited Uses

You agree not to use the Bot to:

• Conduct illegal activities or giveaways
• Harass, threaten, or discriminate against users
• Violate intellectual property rights
• Conduct giveaways that violate Discord's Terms of Service
• Attempt to exploit bugs or vulnerabilities in the Bot
• Use the Bot in a way that could damage, disable, or impair the service

5. Data Collection and Privacy

The Bot collects and stores the following data necessary for giveaway functionality:

• Discord Guild IDs
• Discord Channel IDs
• Discord Message IDs
• Discord User IDs of giveaway participants
• Discord Role IDs for blacklist/bypass functionality
• Giveaway configuration data (prizes, durations, winner counts)

This data is stored in MongoDB databases and cached in Redis for performance. Data is retained indefinitely unless manually deleted using the /giveaway delete command.

6. Service Availability

6.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. The Bot may be temporarily unavailable for maintenance, updates, or due to unforeseen circumstances.

6.2 Changes to Service

We reserve the right to modify or discontinue the Bot or any part of the service with or without notice.

7. Limitation of Liability

7.1 No Warranty

THE BOT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

IN NO EVENT SHALL THE BOT DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE BOT
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY USING THE BOT
• ANY OTHER MATTER RELATING TO THE BOT

8. Intellectual Property

8.1 Bot Intellectual Property

All rights, title, and interest in and to the Bot (excluding content provided by users) are and will remain the exclusive property of the Bot developers.

8.2 User Content

You retain ownership of any content you create using the Bot, including giveaway descriptions, images, and configuration settings.

9. Termination

We may terminate or suspend your access to the Bot immediately, without prior notice or liability, for any reason, including if you breach these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through Discord announcements or Bot status updates. Continued use of the Bot after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Bot developers are based, without regard to its conflict of law provisions.
